Don, thanks for sharing the correspondence with Shelby. Of course, the FAA's position is always absolute...until it changes, when the absolute boundaries are redrawn. As they say, we live in interesting times.
I don't see any special disregard directed at Light Sport Aviation from the FAA. I think they manage to hold everyone in equal disregard.

Agreed Paul... Had my fill of their abuse when I was finishing the Babybird... At that time, FAA Inspector came for your airworthiness inspection of a new experimental. All I got was "that think can't fly", "where is the rest of it", and I can't approve this thing"... I have no doubt there will be changes to the ADS-B Out specifications, when the FAA finally admits they have miscalculated, new guidance will be issued. Just don't count on competency from the FAA.
